Privoxy and QoS

so i guess i forgot my login to http://svn.dd-wrt.com/login i cant re-register atm cause of an error (and don't know of a reset password link?) but.. Privoxy seems to bypass QoS is there a way to make it so it uses QoS as well?

[Netgear WNDR3700 V4]
[DD-WRT v24-sp2 (02/19/14) std - build 23598]
1. Setup QoS (set downlink)
2. Save
3. Enable Privoxy [Services>Adblocking] (with or without Transparent Mode)
4. Apply
*5. Set proxy on https (and http if Transparent Mode off) [default- 192.168.1.1:8118]
5. Go to Status>Bandwidth
6. Load Youtube video (https or http just make sure its going through Privoxy)
7. Watch downlink exceed limit

*only needed if you go to https (or if you have Transparent Mode off)

its weird because http://www.speedtest.net/ reports correctly but apparently some cases bypass QoS going through Privoxy?
